Steno maintains backup Zoom recordings for certain proceedings to ensure accurate transcript production in case of technical issues with the court reporter's recording. This backup footage runs continuously throughout the proceeding, capturing both on-the-record and off-the-record conversations.
Standard Policy for Raw Footage Requests
- Steno does not release raw backup footage as a standard practice.
- Raw footage is maintained solely as a backup measure for transcript accuracy.
- All requests for raw footage must be accompanied by proper legal documentation (i.e., a valid subpoena), which Steno will review and handle as stated below.
Requirements for Production
Steno will only release raw backup footage under the following circumstances:
- In response to a valid subpoena:
- The requesting party must provide a properly executed subpoena
- Other parties may object to the production.
- If there are objections, Steno will produce the requested files only in response to a valid court order.
- In response to a court order.
Post-Recording Video Requests
Steno will not edit or produce raw backup footage as a substitute for professional videography services. Specifically:
- If no videographer was present during the proceeding, Steno will not:
- Edit the raw Zoom backup footage.
- Produce video files for a fee.
- Create video products after the fact.
This policy exists to maintain the integrity of our services while protecting our relationships with court reporters and videographers. It helps us ensure consistent, high-quality customer service while preserving our neutral position in legal proceedings.
Additional Notes
- Backup recordings are not made for all proceedings.
- The continuous nature of backup footage means it contains off-the-record conversations.
- Requests for footage related to specific incidents not captured in the transcript must still follow the subpoena requirement.
- Steno reserves the right to use the backup footage to quality control the transcript unless instructed not to do so.
